Influencer gifting and product seeding: how to do it properly

Influencer gifting vs product seeding vs paid posts, the FTC disclosure rule that applies to free products, and a step-by-step seeding process for brands.

Influencer gifting means sending a creator your product for free with no obligation to post. Product seeding is gifting at scale: you send product to many creators at once and hope a share of them post about it. Neither is free marketing. The product, the shipping and the time cost money, and the disclosure rules apply even when no money changes hands.

The disclosure rule for free products

The FTC's Disclosures 101 for Social Media Influencers says a material connection includes a brand giving you free or discounted products. It also says: if a brand gives you free products and you then mention one of its products, make a disclosure even if you were not asked to mention it. The disclosure has to sit with the post itself, not only in a bio or behind a 'more' link, and simple words like 'ad', 'sponsored' or 'Thanks to [brand] for the free product' work.

So put the disclosure ask in the note that ships with the product. Creators carry the legal duty, but a brand that seeds without saying it is setting its creators up to break the rule.

How to run a product seeding campaign

  1. Pick creators whose recent posts already cover your category, so the product fits what they make anyway.
  2. Ask before you ship. An unsolicited package is a bad first impression, and a creator who says yes is more likely to open it and post.
  3. Include a short card: what the product is, one line on why you picked them, and the disclosure ask. No posting demands.
  4. Track who posts, with a unique code or link per creator, so you can see which creators to offer paid work next.
  5. Turn the creators who posted well into paid partners with a proper influencer brief and contract.

When gifting should become a paid deal

The moment you need a specific deliverable, a deadline, usage rights for ads or approval before posting, gifting is the wrong tool. That is a paid deal and needs a brief and a contract. On UGCBloom, the sourcing agent finds creators for the brief, the negotiation agent agrees rate and terms, a signed contract gates the submission, and the creator is paid on approval.

Pay for results only: 30% (no output, no cost), or pay per individual agent at $999/month per campaign. Describe your campaign and get a free campaign brief and creator sourcing done for free.

Look at your last seeding list. If you cannot say which creators posted and what it produced, track that before you ship the next box.
